Planning

Planning for a garden room

Inside the 2026 exemption when every condition is met: up to 30 m²

From 27 July 2026 a garden room of up to 30 m² can go in without a planning application, within the conditions. Every size we build is inside that figure on its own. What is already in the garden counts, so we measure it before we price it.

The conditions
  • Behind the front wall of the house, in the back or side garden
  • No more than 30 m² counting every shed, garage, greenhouse or other garden building already in the garden. An extension on the house does not count here
  • At least 25 m² of garden left to the back or side of the house
  • Beside the house, the outside finish, and a tiled or slated roof, match the house
  • No more than 3 m high, or 4 m with a tiled or slated pitched roof. Any other pitched roof is 3 m
  • Used with the house: an office, a gym, a studio, a hobby room, storage. Not a home
S.I. No. 338 of 2026, article 4, Class 3 of Part 1 of Schedule 2 of the Planning and Development Regulations 2001. Checked 15 October 2026. The 2026 rules in plain words

A detached garden building of 25 m² or less, no more than 3 m high or 4 m with a pitched roof, used only for recreation or storage and never for a business or as a home, is outside the Building Regulations. Over 25 m², they apply to how it is built. A planning exempt garden room used only for recreation or storage needs no notice to building control before it starts. One used for a business needs a fire safety certificate and a disability access certificate first. A garden room used only for recreation or storage, and not for a business or as a home, needs no fire safety certificate. Questions

Questions people ask

Request a quote
Do I need planning permission for a garden room?

Usually not, since 27 July 2026. The main conditions: it is 30 m² or less, counting every shed, garage or garden building already there. It sits behind the front wall of the house. It leaves at least 25 m² of garden to the back or side. It is no more than 3 m high, or 4 m with a tiled or slated pitched roof. And it is used with the house, not as a home. Those are the main ones: the full list, and where the exemptions do not apply, are on our planning page. Every size we build is inside the 30 m² on its own. (S.I. 338 of 2026, Class 3.)

Does my shed count towards the 30 m²?

Yes. The 30 m² is every garden building together: sheds, a garage, a greenhouse, an earlier garden room. A 16 m² shed and a 15 m² garden room come to 31 m², over the limit. An extension on the house does not count here. It has its own 45 m² total. We measure what is there before we price it.

How long does it take?

About 4 weeks from your deposit to the start of the build. Most of the build happens off site.

How do payments work?

The site visit and the design are free. A €1,000 booking deposit holds your build slot. It is refunded in full if nothing has been started or spent on materials or design; if something has, we refund what is left. Then 80% of the balance when the build starts, and 20% midway through the build.

Can a garden pod be used as a granny flat?

No. A garden pod is for use with the house: an office, a gym, a studio, storage. It is not a home. For a home in the garden, see Garden homes.

Do building regulations apply?

It depends on the size and the use. A detached garden building of 25 m² or less, no more than 3 m high or 4 m with a pitched roof, used only for recreation or storage and never for a business or as a home, is outside the Building Regulations. Our two largest sizes, 26.25 and 28 m², are over 25 m², so the Building Regulations apply to how they are built, and we build them to it. A planning exempt garden room used only for recreation or storage needs no notice to building control before it starts. One used for a business needs a fire safety certificate and a disability access certificate first. (Building Regulations 1997, Third Schedule, Class 2; Building Control Regulations 1997, article 7(2).)
